The grounds for divorce in the state of New Jersey are divided into two categories: “no fault grounds” & “fault grounds.” No fault grounds consist of living separate and apart for a minimum period of 18 months and/or irreconcilable differences that have caused a division in the marriage for a minimum period of 6 months. Fault grounds consist of adultery, cruelty, desertion, drug addiction, habitual drunkenness, deviant sexual behavior, institutionalization and/or imprisonment.
Divorce mediation is a process in which an impartial third party aids both spouses in reaching an agreement on the key issues like child custody, child support, alimony and equitable division of assets. Since mediation is a voluntary process in which both parties must agree to participate, couples able to communicate openly and civilly are usually good candidates.
Every divorce is unique and costs naturally vary from case to case. The cost of a divorce is determined by the methods used to dissolve your marriage, whether you and your spouse agree on issues like alimony and child support and the law firm you hire to represent you.
The majority of divorce cases in the state of New Jersey do not go to trial. Rather, most are settled out of court with the assistance of attorneys and/or professional mediators. When parties cannot agree on a settlement, the case is brought before a judge who then makes decisions on any issues in dispute including child custody, child support and spousal support.
