Our family law attorneys help clients receive their share of retirement plans
Preparation for a Qualified Domestic Relations Order or QDRO occurs coincident with a divorce judgment. A QDRO is a legal order that gives the divorced spouse a share of a retirement plan or pension plan. Understanding qualified domestic relation orders
Whether your divorce is just beginning or coming to an end, attempting to understand complicated legal processes can be difficult. A QDRO distributes funds from the retirement plan of the owner or participant to a spouse or alternate payee. A QDRO may also be used to enforce child support, alimony or spousal support payments, or marital property rights for the benefit of a spouse, former spouse, child or other dependent of a participant.
A domestic relations order must contain the following information in order to qualify:
Name the participant and alternate payee
Address of the participant and alternate payee
Name of each plan the order applies to
Monetary amount or percentage to be paid to the alternate payee
Number of payments or time period to which the order applies
